End-User License Agreement for TOP TAG PET ID

This Top Tag Pet ID End-User License Agreement is between Flash Drive Publishing, Inc. an Arizona Corporation and any purchaser or user of the Top Tag Pet ID product and services who accepts the terms of this Agreement. (Top Tag Pet ID is a software program published by Flash Drive Publishing, Inc. on a custom-built mini flash drive.) The Top Tag Pet ID Software Program is licensed, not sold. By using the 64MB Top Tag Pet ID Flash Drive and the Top Tag Pet ID software program contained therein you agree to the following:

You MAY insert the flash drive in any Windows based computer USB port and fill out or view the Fact Sheet and/or download photos.

You MAY print out copies of the Fact Sheet for your personal use only. You MAY use Screen Captures of the Top Tag Pet ID Fact Sheet for your personal use only. Those writing reviews of the Top Tag Pet ID software program may also use Screen Captures in their articles. You MAY NOT copy the Top Tag Pet ID software program to a computer hard drive or to any other flash drive device. Top Tag Pet ID is protected by international copyright laws and any violation will be prosecuted to the fullest extent of the law.

You MAY NOT sell, resell, license, rent or otherwise transfer for value, the Top Tag Pet ID software program.

You MAY NOT distribute or post the Top Tag Pet ID software program, in whole or part, on any computer network or on the Internet. You agree to indemnify and defend Flash Drive Publishing, Inc. against any claims, lawsuits, and attorneys' fees that are a result of your unauthorized use of the Top Tag Pet ID software program.

You MAY NOT display the Top Tag Pet ID software program on any web site maintained by you or a third party.

You MAY NOT hack or otherwise bypass the technological measures installed on the Top Tag Pet ID Flash Drive to protect the Top Tag Pet ID software program from unauthorized use.

You MAY NOT use any of the Top Tag Pet ID or Flash Drive Publishing, Inc. trademarks or service marks without written authorization from Flash Drive Publishing, Inc.


Usage of Top Tag Web Site

By using this web site you agree to adhere to and be bound by the following terms and conditions.

You may view and download, for your personal (non-commercial) use only, information and materials contained on this site including the driver for Windows 98 and the pet alert posters.  You must retain all copyright and other proprietary notices posted on the original materials.  None of the Top Tag Pet ID materials may be altered in any way or form and cannot be publicly displayed, reproduced or distributed including networked computers or other web sites.

We encourage you to link to Top Tag Pet ID web site but you must comply with the following conditions:

Your link may not replicate any Top Tag Pet ID content
You may not imply or state that the link is an endorsement by Top Tag Pet ID
You may not create a browser or border around any Top Tag Pet ID content
You may not use the Top Tag Pet ID logo without written permission from Flash Drive Publishing, Inc.
You may not misrepresent your relationship with Top Tag Pet ID, or imply, infer or state you have a relationship with Top Tag Pet ID when no such relationship exists.
You may not publish any false information about Top Tag Pet ID or Flash Drive Publishing, Inc.

If you fail to adhere to any of the terms and conditions spelled out above, your authorization to use the Top Tag Pet ID web site is automatically terminated and you must destroy any downloaded or printed materials.


Liabilities

LIMITATION OF LIABILITY - Flash Drive Publishing, Inc., an Arizona corporation, will not be held liable for damages – in excess of the amount of what the customer paid for the Top Tag Pet ID – when there is lost or inaccurate data or a customer's computer becomes corrupt, even if Flash Drive Publishing, Inc, had been informed of the possibility of such damage.

In addition, Flash Drive Publishing, Inc. will not be responsible for any injury or death of a pet due to any use of the Top Tag Pet ID. It is the pet owner's responsibility to ensure the Top Tag Pet ID waterproof case is tightly locked together and is securely attached to a collar worn by the pet. The pet owner must monitor the pet's behavior for a few days following the attachment of the Top Tag Pet ID to the pet's collar to make certain the pet is not trying to chew or remove the Top Tag Pet ID.

Flash Drive Publishing, Inc. is not responsible for any damage to or loss of data on the mini Top Tag Pet ID caused by your pet biting and/or playing with the waterproof case and mini Flash Drive.


Trademark Notice

All trademarks displayed on this site (www.toptagpetid.com) are owned exclusively by Flash Drive Publishing, Inc., or are used by Flash Drive Publishing, Inc. under license. These trademarks include marks that are registered and unregistered and include, but are not limited to, product brand names, slogans, and logos and emblems. The unauthorized use of any trademark owned or used by Flash Drive Publishing, Inc. is strictly prohibited.
